The Failure of the 28-Article Peace Initiative for Ukraine: How Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis triggered by the introduction of a new 28-article proposal for achieving ceasefire appeared – briefly – to have been stabilised. A senior US official spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: an extensive attack of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of opposing developments captured the bleak nature of the recent timeframe. By day, diplomatic battles are conducted: hopeful statements are issued from different nations. Immense energy is allocated on restraining specific proposals. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the primary tool for achieving "resolution".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the current condition of Ukraine's exposure was laid bare. Ukraine is equipped to monitor missile launches from enemy soil, a capacity enabled by current data. From observation points, Ukrainian air force fighter jets that had been dispatched to engage hostile cruise missiles streaked across the sky – advanced fighter aircraft delivered to Ukraine by Western partners.

Soon thereafter, Kyiv's air-defence systems activated: multiple launches targeted at a hostile projectile. This was a modern interception technology at work, most likely delivered by allied countries. Every firing creates sudden vibrations, causing tremors. The instant of fear quickly gives way to sober acceptance: maybe the incoming missile won't hit its mark this time, preventing destruction from catastrophe and further power outages.

Ongoing Risks

Soon after, a large-caliber weapon fired at a aerial vehicle close by, part of a rapid response unit – most likely Western-made equipment. Unfortunately, the shots failed to hit the opposing UAV – it maintained course toward its target.

Periodically, this persisted until dawn. Kyiv awoke to the daybreak reports: seven people killed, devastation and utility failures in many homes as a result of the nocturnal offensive. As customarily, everyone still maintained normal activities – experiencing conflict. But those full day illustrated Ukraine's vital need on Western support – a dependence that neighboring countries are evidently unprepared to replace in the short term.

Ineffective Peace Efforts

The comprehensive proposal from American leadership provoked deep reactions, debate and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new approach from American administration adheres to the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They stabilise the situation but never actually achieve victory. This pattern will, no doubt, continue.

Tactical Assessments

It is tempting to accuse specific actors of consistently pushing Moscow's conditions. But that does not seem to be the entire situation. American leadership works based on a principle familiar among experienced diplomats: you cannot win at the negotiating table what you have lost on the battlefield. The White House believes that it is unrealistic to compel Moscow to surrender the territory that it already controls in Ukraine's south or east.

The problem is that while accepting these circumstances, Washington does minimal to discourage Russia, through diplomacy or military means, from thinking that the situation will not evolve additionally in its advantage in the months ahead.

Opposing Positions

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their incentive to agree to terms that does not give them the maximum possible gain is virtually nonexistent. There may be many attempts to stop fighting, but they will carry on as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing civilians and areas but preventing a complete military breakdown until conditions improve in its benefit.

Current Realities

Realistically, there are no actual prerequisites for a ceasefire. Now, personal considerations are coming into play: leadership ambitions to negotiate peace and achieve global acclaim, and Ukrainian leadership's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the national cause against any initiative Kyiv finds unsuitable, so that their attention does not move to domestic problems. And although their task will now be much harder after latest incidents, it remains highly unlikely that this will alter their fundamental strategy.

These two forces are driving the talks.

Summary and Prospects

It took a just a single week to eliminate the proposed articles of the latest plan. Aggressive and erratic handling of the matter by American leadership, resistance by Ukraine and the remaining European nations, along with calming attempts of diplomats, and finally, latest revelations, all did their job.

While new plans based on established approaches are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are founded on Moscow's terms and demonstrate certain reluctance to alter the situation, if they maintain solidarity and enhance their military capacity at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the foreseeable future, primarily depend on sustained allied backing.
